Regarding the dead who must be bathed, the Fikh scholars agreed to bathe the bodies of Muslims who did not die fighting infidels. So what about the martyrs in Palestine who have fallen?
Ibn Rusyd in his book Bidayatul Mujtahid wa Nihayatul Muqtashid explains that, although there is agreement on this, scholars disagree on the law of bathing and keeping the bodies of the fallen as martyrs, and those who died in a state of infidelity.
In the case of a person who is martyred, that is, a person killed by an infidel in the field of war, according to the majority of scholars he should not be bathed. This refers to the Prophet’s hadith, he said, “The Messenger of Allah (may Allah’s peace and blessings be upon him) ordered to take care of the casualties of the Uhud War. Then they were buried with their clothes, and he did not restrain them (Bukhari and Muslims).
Al Hasan and Said bin Al Musayyab said that every dead Muslim should be bathed, because every corpse bears a junub. Perhaps they think that what was done to the victims of the Uhud War (not bathing them) was forced (emergency). That is, it was very difficult at that time to bathe them.
Faithful scholars agree that it is not necessary to bathe martyred people in wars against pagans, they disagree about bathing martyrs because they are killed by thieves or nonbelievers. According to Al Auzai and Imam Ahmad, the law is the same as that of the martyred dead who are killed by pagans. While according to Imam Malik and Imam Shafii, he should be bathed.
